A federal judge has granted Nirvana’s motion to dismiss a lawsuit filed by Spencer Elden over his nude depiction as a baby on the cover of their Nevermind album.
On Monday (January 3rd), US District Court in Central California Judge Fernando M. Olguin dismissed the case “with leave to amend,” after Elden’s camp failed to respond to the Nirvana legal team’s filing to the lawsuit last month.
Don’t forget Mr. Elden has a tattoo of the album cover and celebrated the anniversary of the album by re-taking the picture and taking some $$$$.
