An Evansville man found guilty in the death of his infant son is heading back to court for a new trial.
In 2023, Taylor Fischer’s son, Carson, passed away with fentanyl and other drugs in his system.
He was sentenced to 30 years in prison.
Fischer’s legal team says under the circumstances, he has met his burden of demonstrating how, in light of all the evidence in the case, the error’s probable impact undermines confidence in the outcome of the proceeding.
They want Fischer’s conviction for neglect of a dependent reversed as a Felony 1 and demand that he be retried on that charge.
